Yesterday, the 9th Circuit Court ruled in a 2-1 decision that Proposition 8 is unconstitutional. The judges stated that Proposition 8 violates the Fourteenth Amendment to the Constitution because it "serves no purpose, and has no effect, other than to lessen the status and human dignity of gays and lesbians in California, and to officially reclassify their relationships and families as inferior to those of opposite-sex couples." leap-year.jpg

The case is now headed to the U.S. Supreme Court, but the way the judges decided the case yesterday means that a U.S. Supreme Court ruling will likely only repeal the ban in California and not require them to rule on marriage equality for same-sex couples nationally.

One line from the decision that was particularly poignant was when the Justices pointed out that "had Marilyn Monroe's film been called 'How to Register a Domestic Partnership With a Millionaire' it would not have conveyed the same meaning as her famous movie..." Ain't it the truth!

Let's keep leaping toward equality and keep the fire for equality burning strong this month. This is a leap year, after all, and the year of the Dragon. On Valentine's Day join same-sex couples and their supporters by going to local marriage license counters across the country and ask that marriage licenses be given to same-sex couples.

You can also join same-sex couples who are already legally married and will go to their local federal building to ask for the marriage tax penalty and the right to have their marriages recognized by the federal government and access to the 1,138 federal marriage rights currently denied under DOMA.

Let's occupy love and equality and make sure that same-sex couples have the same rights as different sex couples.
